These conditions of sale are concluded on the one hand by the SARL Tropic-Alizés. with a capital of 23,000 euro whose registered office is at 1580 route des plages 97354 REMIRE MONTJOLY, registered in the Cayenne Trade and Companies Register under the number 423 118 702 00020 hereinafter referred to as “Tropic-Alizés” and on the other hand, by any individual or legal entity wishing to proceed with a purchase via the “Tropic-Alizés” website hereinafter referred to as the “purchaser.”
Purpose
These conditions of sale aim to define the contractual relations between Tropic-Alizés and the buyer and the conditions applicable to any purchase made through the Tropic-Alizés merchant site, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of the present conditions of sale. These conditions of sale shall prevail over any other general or particular conditions not expressly approved by Tropic-Alizés. Tropic-Alizés reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions shall be those in force at the date of the order by the buyer. Characteristics of the goods and services offered The products and services offered are those which appear in the catalogue published on the Tropic-Alizés website. These products and services are offered within the limits of available places.
Prices
The prices appearing in the catalogue are net prices in euros. Tropic-Alizés. reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer.
Orders
The buyer, who wishes to buy a product or a service must obligatorily:
– Reserve his or her place(s) by telephone, email or other means to Tropic-Alizés
– Confirm his or her reservation on the Tropic-Alizés website by paying a deposit or the total amount
– To do so, he or she must – fill in the identification form on which he or she will indicate all the requested contact details or give his or her customer number if he or she has one; – fill in the online order form giving all the references of the products or services chosen; – validate the order after having checked it; – make the payment in accordance with the conditions laid down; – confirm the order and the payment. All the data provided and the recorded confirmation will be considered proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
The seller will communicate by e-mail confirmation of the recorded order.
Cancellation
Buyers, non-professional physical persons, benefit from a cancellation period of eight days for reimbursement without penalty. In the event that this cancellation is made 7 days before the departure date Tropic-Alizés will retain 25% of the total amount, up to 24 hours 50%, less than 24 hours: no reimbursement. Rain is not a reason for cancellation.
Payment methods
The price is due at the time of ordering either in full or up to 100% of the total amount. Payments concerning the confirmation of the reservation will be made by credit card; they will be made through the secure system of the Crédit Mutuel which uses the SSL ”Secure Socket Layer” protocol so that the information transmitted is encrypted by software and no third party can gain knowledge of it during transport on the network. The buyer’s account will be debited at the time of the commercial and financial transaction. At the request of the buyer, a paper invoice will be sent to him/her.
Performance of the service
If for any reason Tropic-Alizés is unable to provide the service to which the client has subscribed (breakdown on the boat, difficult sea conditions, illness of the staff…) it will be fully reimbursed. Tropic-Alizés has a liability insurance. However, the client remains responsible for his own negligence. Any object of value either by loss or theft cannot be reimbursed by Tropic-Alizés.
Guarantee
All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. All claims or requests for reimbursement must be made by post to the following address Tropic Alizés 1580 route des plages 97354 REMIRE MONTJOLY within thirty days of the execution of the service.
Responsibility
The seller, in the process of selling online, is only bound by an obligation of means; its responsibility cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, break in service, or other unintended problems.
Intellectual property
All elements of the Tropic-Alizés site are and remain the exclusive intellectual property of Tropic-Alizés. No one is authorised to reproduce, exploit, rebroadcast or use in any way whatsoever, even partially, the elements of the site, whether they be software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of Tropic-Alizés.
Personal data
In accordance with the law relating to information technology, files and freedoms of 6 January 1978, information of a nominative nature relating to purchasers may be subject to automated processing. Tropic-Alizés will not collect any information on buyers, including by using cookies.
Archiving-Proof
Tropic-Alizés will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. The computerised records of Tropic-Alizés will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Rule of disputes
These online sales conditions are subject to French law. In the event of a dispute, jurisdiction is attributed to the competent courts of Cayenne, notwithstanding multiple defendants or guarantee appeals.
